This area of the site provides Owner Occupiers with some general information about their responsibilities in relation to their homes.

Selling your Property

If you are selling your property you or your solicitor must notify Clyde Valley Property Services of the date of sale and the name of the new owners. This enables a final invoice to be created for you and details of the new owner to be recorded for future invoicing. Please be advised that there is a £50 charge to cover the administration of a resale, a breakdown of this charge is available on request.

Renting Out Your Property

If you rent your property to someone you must notify Clyde Valley Property Services of your contact details as you will still be responsible for the payment of all factoring invoices. If desired, your account can be sent to you at an alternative address.

Neighbour Disputes

It is recognised that from time to time neighbour disputes can arise and it is worth noting that this can happen when someone does not realise the effect that their behaviour or actions are having on other residents. This can in some cases cause serious upset and all owners should therefore ensure that members of their household and visitors to their house consider other residents at all times.

Anti Social Behaviour

As with neighbour disputes anti-social behaviour occurs when household members or visitors to a household conduct themselves in a manner which causes nuisance to other residents. As an owner you should ensure that all household members and visitors to your home respect the right of the other residents to live in a peaceful and safe environment, however, if you experience problems with anti social neighbours you should contact the the Local Anti-Social Task Force, through your Council who may be able to assist you.

Anti Social Noise Hotline – Telephone 0800 242 024

This service is available from Monday to Sunday from 08:45 am to 03:00 am next morning for all residents in South Lanarkshire to report problems with noise.

Stair Cleaning

If you live in a block of flats you must sweep and clean the common stairs, close and bin area.

In some instances your neighbour may not take their turn and in this type of case it may be useful to arrange a rota for residents.

In certain areas it may be necessary to appoint a contractor to clean the close and in these cases owners will be charged their share of the cost of the close cleaning. This would not be done without owners receiving prior notification.

Dumping Rubbish and Old Furniture

If you need to get rid of bulky rubbish, garden rubbish or old furniture, you should arrange to have it taken away by phoning your local council for a special uplift.

The uplift service allows householders three free uplifts per year with a charge of £15.00 for each subsequent special uplift, or £40.00 for major home improvements. This only applies to owners living in North Lanarkshire Council area as owners in South Lanarkshire can use this service free of charge.

Gardens

As the owner of the property you are responsible for making sure that your garden is kept neat and tidy. This also includes grass, trees, shrubs and hedges within the garden. Depending on your circumstances, help with garden maintenance may be available from the council.

Deed of Conditions

When you purchased your home your Solicitor would have advised you that as an Owner you have certain legal obligations, which are contained within your Title Deeds, that you signed when you purchased your property. The majority of the conditions are detailed in the Deed of Conditions, which is one of the legal documents contained in the Title Deeds.

Detailed below are some of the main conditions found within the Deed of Conditions, however, you should refer to the actual deed for clarification relating to your property and estate. If you do not already have a copy of your Deed of Conditions you should request a copy of the document from your Solicitor.

Conditions likely to be found in the Deed of Conditions:- 

  • access rights for owners 
  • access rights for local authorities / public utility companies 
  • maintenance and alteration of your property
  • boundary fences and walls
  • insurance
  • shared charges detailed in clause ninth - outlines that owners are jointly liable for the repair costs incurred in maintaining all the common areas
